Gathering reliable information about employees and workplace incidents in order to make reasonable and informed employment decisions is not new for employers. However, most workplace investigations concerning individual employee issues vary depending on the complexity of the issues and the number of people involved. The commonplace internal investigations are often related to discrimination, harassment, retaliation, theft, and misconduct. However, employers need to be prepared to handle a range of incidents with the appropriate response. With the rise in technology and the global economy, employers are experiencing a host of other issues, including whistleblowing, insider trading, corporate fraud, and misappropriation of trade secrets. An ill-considered response to any of these issues will create even more problems for employers. This webinar will provide best practice on preparing for and conducting internal investigations for a variety of workplace issues. The webinar will discuss appropriate investigation policies and procedures, pre-investigation planning, attorney-client privilege considerations, investigation tips and witness interviews, and post-investigation disciplinary measures.
ABOUT THE PRESENTERS
Aaron Gelb heads Conn Maciel Carey’s new Chicago office. His practice specializes in labor & employment and OSHA litigation. He has extensive experience litigating equal employment opportunity matters in federal and state courts, having tried numerous cases to verdict and defended employers before the EEOC as well as fair employment agencies nationwide. Aaron also advises employers through inspections, investigations, and enforcement actions involving fed OSHA and state OSH programs, and manages the full range of litigation against OSHA.
Daniel C. Deacon is an Associate in the Washington, DC office of Conn Maciel Carey, working in both the Labor and Employment and OSHA • Workplace Safety Practice Groups. Dan's practice focuses on all aspects of occupational safety & health law and labor and employment law. He represents employers in inspections, investigations and enforcement actions involving OSHA and other state and local safety related agencies.
